Kunstiek respects your privacy and handles personal data with care. This Privacy Policy explains which personal data we process, why we process it, with whom it may be shared and what rights you have.

1. Who is responsible for your personal data?

2. Which personal data do we process?

Depending on how you interact with Kunstiek or use our website, we may process the following types of data:

- your name and contact details, such as your address, email address and telephone number;
- billing and delivery details;
- information relating to purchases, sales, consignments, returns and other transactions;
- payment and transaction details;
- correspondence by email, telephone, contact form or social media;
- information you provide when signing up for a newsletter or notifications about new works of art;
- technical data relating to your use of our website, such as your IP address, browser information and information about pages visited;
- data that we are required to collect by law, for example for administrative purposes or customer due diligence.

3. For what purposes do we use personal data?

Kunstiek processes personal data for the following purposes:

- answering enquiries and maintaining contact;
- performing purchase, sale and consignment agreements;
- processing orders and payments;
- delivering, shipping or collecting works of art;
- invoicing and financial administration;
- handling returns and complaints;
- searching for specific works of art at your request or sending notifications about new works of art where you have signed up for such notifications;
- sending newsletters and other marketing communications for which you have subscribed;
- securing, analysing and improving the website;
- preventing and investigating fraud and misuse;
- complying with legal obligations, including tax obligations and, where applicable, obligations under anti-money laundering legislation.

4. On what legal basis do we process personal data?

We only process personal data where there is a valid legal basis for doing so.

Depending on the circumstances, this may be:

- the performance of a contract with you or taking steps at your request before entering into a contract;
- compliance with a legal obligation;
- a legitimate interest of Kunstiek, for example in relation to security, administration, customer service and improving our services, provided that your privacy interests do not override those interests;
- your consent, for example for newsletters, certain email notifications and tracking cookies.

Where processing is based on your consent, you may withdraw that consent at any time.

Kunstiek does not make decisions based solely on automated processing that produce legal effects or similarly significant effects for you.

5. Newsletters and notifications about works of art

You may subscribe to the Kunstiek newsletter or to email notifications about new works by specific artists.

For this purpose, we use your email address and, where provided, your name and preferences.

You may unsubscribe at any time by using the unsubscribe link in the email you receive or by contacting Kunstiek.

Kunstiek uses Klaviyo to send and manage these emails. Klaviyo may process personal data to the extent necessary to provide these services.

6. Webshop, payments and third-party services

Kunstiek’s website and webshop are hosted on Shopify.

Shopify processes certain customer data on behalf of Kunstiek in order to provide the webshop and related services. In relation to customer data, Kunstiek generally acts as the data controller and Shopify as the data processor, insofar as Shopify processes data on behalf of Kunstiek.

Personal data may be processed by our payment provider, including Mollie, in connection with payments.

For shipping or delivery, necessary information such as your name, address and contact details may be shared with the carrier or courier responsible for the delivery.

We only share data that is necessary for the relevant service.

7. Cookies and website analytics

Kunstiek uses cookies and similar technologies.

Functional cookies are necessary for the proper operation of the website. In principle, consent is not required for these cookies.

Analytical cookies may also be used to gain insight into how the website is used. Kunstiek uses, among others, Google Analytics and Microsoft Clarity for this purpose.

Where consent is required by law for cookies or similar technologies, these are only placed after you have given consent through the cookie settings.

You can adjust your cookie preferences through the cookie settings on the website and withdraw previously given consent.

8. Sharing personal data with third parties

Kunstiek does not sell personal data.

Where necessary, personal data may be shared with parties that provide services to Kunstiek, including:

- Shopify for the webshop and technical infrastructure;
- Mollie and other relevant payment providers for payments;
- Klaviyo for newsletters and email notifications;
- carriers and couriers for the delivery of works of art;
- Google and Microsoft for website analytics, insofar as permitted by your cookie preferences;
- IT, hosting or other service providers that are necessary for our business operations;
- accountants, bookkeepers, advisers or public authorities where this is necessary or required by law.

Where appropriate, agreements are made with parties that process personal data on behalf of Kunstiek regarding the protection of personal data.

9. Transfers outside the European Economic Area

Some of Kunstiek’s service providers operate internationally. As a result, personal data may in certain cases be processed outside the European Economic Area (EEA).

Where this occurs, appropriate safeguards are applied as required by the GDPR, for example an adequacy decision of the European Commission or approved standard contractual clauses.

10. How long do we retain personal data?

Kunstiek does not retain personal data for longer than necessary for the purpose for which it was collected, unless a longer retention period is required by law.

Data forming part of our tax records is generally subject to a statutory retention period of 7 years.

Data used for newsletters and email notifications is retained until you unsubscribe or until the data is no longer required.

Correspondence and other customer data are deleted when they are no longer necessary for the provision of services, administration, potential legal claims or other legitimate purposes.

11. Security

Kunstiek takes appropriate technical and organisational measures to protect personal data against loss, unauthorised access, misuse and unauthorised alteration or disclosure.

However, no digital system can guarantee absolute security.

12. Your privacy rights

Under the GDPR, depending on the circumstances, you have the right to:

- request access to your personal data;
- have inaccurate personal data corrected;
- request deletion of personal data;
- request restriction of the processing of personal data;
- object to certain processing activities;
- receive personal data in a portable format;
- withdraw previously given consent.

You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Kunstiek may amend this Privacy Policy if our services, systems or applicable laws and regulations change.
